freeX guarantee the airworthiness of all paragliders for either a period of 3 years or for 300 flying hours (whichever is reached first).

1. Scope of the guarantee

The warranty period begins on the day of purchase. In accordance with the guarantee, a paraglider shall be repaired of replaced if it is proven to be unsuitable for use owing to faulty manufacture of materials. Repair work or replacement does not result in an extension of the guarantee period. freeX shall take possession of all replaced parts.

2. Requirements

The guarantee is only valid if: a) the guarantee card is filled in fully and correctly and is returned to freeX within 7 days of purchase (the date of the postmark is decisive). b) the purchaser records details of his various flights - in particular his/her flying hours - in a logbook, which is to be updated at regular intervals and countersigned by another paraglider pilot or by a similarly qualified person. c) the paraglider is handled in accordance with the instructions in the operating manual and on the Carrington tag. this applies, in particular to the cleaning, drying, packing and storing of the paraglider. d) the paraglider is inspected, at the latest, 2 years or 200 flying hours - whichever is reached first - by freeX ( or by parties authorized by freeX) at the purchaser's expense. e) the customer observes all legal stipulations regarding the maintenance of the paraglider's airworthiness which are valid in relation to him/her.

3. Guarantee claims

Should a customer wish to make guarantee claim, the customer shall send the paraglider to freeX together with a copy of the purchase receipt at his/her own cost and risk. It shall be returned to the customer from there (postage not prepaid).

4. Validity

This guarantee only covers paragliders which are used for leisure purposes. Paragliders which are used in schools or in training, for professional purposes or in highly demanding situations (e.g. competition, aerobatics etc. ) are not covered by this guarantee. Neither does this cover: a) fading of the colour of the canvas,
b) damage caused by solvents of petrol, salt water or chemicals,
c) any damage resulting from accidents (including take-off, landing and during flight itself),
d) damage caused by the purchaser,
e) damage caused in emergency situations,
f) damage caused by incorrect use,
g) paragliders whose serial numbers have been removed, damaged, or altered,
h) damage caused by third parties, non-authorised modifications or misuse,
i) damage caused by force majeure.

This guarantee is only valid for the purchaser him/herself and is not transferable.

5. Exclusion of further liability

In addition to the legal law of warranty, the customer also has the rights included in this guarantee agreement. Firstly, the customer has the right to receive repairs and replacements in all cases. Should these repairs or replacements fail repeatedly, then the customer can, in this respect, make claims for cancellation or abatement. In addition to this, freeX are not liable, in any respect, for damage caused directly or indirectly or for secondary or subsequential damage, regardless as to whether this is based on contracts or other legal claims.

6. Conclusion

German law applies. UN purchasing law does not apply. Court of jurisdiction is in the principal place of business of freeX.
